企業發展的各個問題都會遇到。那麼要麼有合適的制度,要麼有合適的人。這種問題是回缺乏經驗和管理答制度造成,有兩點失誤:一是沒有法律防範意識,簽訂勞動合同,如果要延長試用期,可以簽訂三年的,6個月試用期,不行就辭退也沒事;二是在公司補償這個員工的時候,一定要簽署「不再有任何勞動糾紛」的文字協議,這樣他也不會反過來咬你了。
這種員工,可以判斷是惡意的,鑽法律的空子,而且做法還合法。雖然拿了你的補償,還是會反悔,像我們說的「拿起筷子吃飯,放下筷子罵娘」。
從道義上講,這類人是人渣。
企業既然因為自己的兩個失誤造成了問題發生,而且勞動局已經受理立案,那麼最好去和那個員工協商解決,但是如果不能協商,那麼勞動局限期整改處罰了,或者走仲裁程序。走關系是沒用的,因為立案要結案,誰也不能取消這個案子,最多隻能幫你協調減少賠償。
吃一塹長一智吧,減少弊端,以後不出這類問題就可以了。至於佔到那邊,還是要良心說話的。
