外觀設計專利是專答利權的客體，是專利法保護的對象，是指依法應授予專利權的外觀設計。它與發明或實用新型完全不同，即外觀設計不是技術方案。中國《專利法》第二條中規定：「外觀設計，是指對產品的形狀、圖案或者其結合以及色彩與形狀、圖案的結合所做出的富有美感並適於工業應用的新設計。可見，外觀設計專利應當符合以下要求：

屬於同類產品是進行外觀設計侵權判定的前提 1.外觀設計專利侵權判定中，應當首先審查被控侵權產品與專利產品是否屬於同類產品。不屬於同類產品的，一般不構成侵犯外觀設計專利權。 被控侵權產品的外觀設計與專利產品的外觀設計相同，但是，如果二者不屬同類產品，則一般不能進行比較，更不能進行侵權判斷。在這一點上，外觀設計的侵權判定，與發明和實用新型的專利侵權判定完全不同。確定是否為同類產品，是外觀設計侵權判定的前提。確定這個前提，對被控侵權產品與外觀設計專利是否相似作出判斷尤為重要。 2.審查外觀設計專利產品與侵權產品是否屬於同類產品，應當依據商品銷售的分類習慣和客觀實際情況，並參照外觀設計分類表，對二者是否屬於同類產品作出認定。 外觀設計專利授權審查和侵權判斷都要考慮是否同類產品的問題，一般都不作跨類判斷。但是，在怎樣確定同類產品上，授權審查和侵權判斷所採用的標準是完全不同的。 在授權審查中，主要根據《國際外觀設計分類表》，看一項外觀設計產品申請專利時使用的產品名稱屬於分類表中哪一大類，哪一小類。然後，看不同小類中的產品是否相同或者相似的外觀設計，如果申請日前已有相同或者相似的外觀設計，則該外觀設計申請便不能被授予專利權。而在侵權判斷中，一般不是直接按照《國際外觀設計分類表》去確定產品類別。因為，這不符合侵權的發生、認定規則。發生外觀設計專利侵權時，在侵權產品上並不會標明該產品屬於《國際外觀設計分類表》中的哪一類，如果原告硬將侵權產品作一個分類，作為被控侵權人也不一定同意。因此，在司法實踐中，應當依據當事人提供的證據，按照被控侵權產品和外觀設計專利產品的商品分類規律和習慣、根據商品銷售和消費者購買的實際情況，來確定兩者是否屬於同一類產品，此時，《國際外觀設計分類表》只能作一個參照。 《國際外觀設計分類表》中，09類是用於商品運輸或裝卸的包裝和容器，28類是葯品、化妝品、梳妝用品和器具，具體還要看是啥產品咯。

Ⅸ 外觀設計專利提交起到拿證書大概要多少時間
拿到證書一般要六個月左右。從申請到授權，大概4個月左右，而且現在申請量大、審查嚴格，時間還會有延長。
拿到授權通知後需要繳納辦理登記手續費和當年的年費，繳費完成後，專利局確認，然後轉到出版社，製作證書，再郵寄至專利權人（或者代理機構），這個時間大概兩個月。
