Circular on the provisions on medical treatment period of the employees suffering from illness or non-work-related injuries
The Department of Labor
”Medical Treatment Period” is referred as the period for employees who suffered from illness or non-work-related injuries and need to stop working to be cured, but is not permitted to terminate labor contract.
Employee who suffered from illness or non-work-related injuries and need to stop working to be cured should be given medical treatment period from three months to twenty-four months according to his practical working period and the working period in this unit:
The first article is applicable for the employees who have less than 10 years of practical working period. The employees who have worked in this unit for less than 5 years will be given 3 months medical treatment period; while those who have worked in this unit for more than 5 years will be given 6 months medical treatment period.
The second article is applicable for the employees who have more than 10 years of practical working period. The employees who have worked in this unit for less than 5 years will be given 6 months medical treatment period; those who have 5-10 years working period will be given 9 months medical treatment period;those who have 10-15 years working period will be given 12 months medical treatment period;those who have 15-20 years working period will be given 18 months medical treatment period; those who have more than 20 years working period will be given 24 months medical treatment period.
医疗期三个月的按六个月内累计病休时间计算;六个月的按十二个月内累计病休时间计算;九个月的按十五个月内累计病休时间计算;十二个月的按十八个月内累计病休时间计算;十八个月的按二十四个月内累计病休时间计算;二十四个月的按三十个月内累计病休时间计算。
If the employees who suffered from non-work-related injuries or non-cured diseases (determined by doctors or medical departments) terminated their medical treatment within their medical treatment period, they are not allowed to carry out their original works or those works arranged by the employing units additionally, and their working abilities should be identified by Labor Identifying Committee according to standard of work-related injuries与职业病致残程度鉴定标准。被鉴定为一至四级的,应当退出劳动岗位,expire labor relationship, 终止劳动关系,办理退休、退职手续,享受退休、退职待遇;those who are identified as five to ten degree are not permitted to terminate their labor contract within their medical treatment period.
The working abilities of the employees who suffered from non-work-related injuries or non-cured diseases (determined by doctors or medical departments) should be identified by Labor Identifying Committee according to standard of work-related injuries与职业病致残程度鉴定标 when their medical treatment period are terminated. those who are identified as one to four degree should退出劳动岗位,解除劳动关系,并办理退休、退职手续,享受退休、退职待遇。
This provisional regulation are 本规定自1995年1月1日起施行。

一、关于medical treatment period的计算问题
1. medical treatment period计算应从病休第一天开始,累计计算。
2.病休期间,公休、假日和法定节日包括在内。
二、关于特殊疾病的医疗期问题
根据目前的实际情况,对某些患特殊疾病(如癌症、精神病、瘫痪等)的职工,在24个月内尚不能痊愈的,经企业和劳动主管部门批准,可以适当延长medical treatment period。
