第一章 總 則
第一條 為加強外國人在中國就業的管理,根據有關法律、法規的規定,制定本規定。
第二條 本規定所稱外國人,指依照《中華人民共和國國籍法》規定不具有中國國籍的人員。本規定所稱外國人在中國就業,指沒有取得定居權的外國人在中國境內依法從事社會勞動並獲取勞動報酬的行為。

第三條 本規定適用於在中國境內就業的外國人和聘用外國人的用人單位。本規定不適用於外國駐華使、領館和聯合國駐華代表機構、其他國際組織中享有外交特權與豁免的人員。

第四條 各省、自治區、直轄市人民政府勞動行政部門及其授權的地市級勞動行政部門負責外國人在中國就業的管理。

第二章 就 業 許 可

第五條 用人單位聘用外國人須為該外國人申請就業許可,經獲准並取得《中華人民共和國外國人就業許可證書》(以下簡稱許可證書)後方可聘用。?

第六條 用人單位聘用外國人從事的崗位應是有特殊需要,國內暫缺適當人選,且不違反國家有關規定的崗位。用人單位不得聘用外國人從事營業性文藝演出,但符合本規定第九條第三項規定的人員除外。第七條 外國人在中國就業須具備下列條件:

(一)年滿18周歲,身體健康;

(二)具有從事其工作所必需的專業技能和相應的工作經歷

(三)無犯罪記錄;

(四)有確定的聘用單位;

(五)持有有效護照或能代替護照的其他國際旅行證件(以下簡稱代替護照的證件)。

第八條 在中國就業的外國人應持職業簽證入境(有互免簽證協議的,按協議辦理),入境後取得《外國人就業證》(以下簡稱就業證)和外國人居留證件,方可在中國境內就業。未取得居留證件的外國人(即持F、L、C、G字簽證者)、在中國留學、實習的外國人及持職業簽證外國人的隨行家屬不得在中國就業。特殊情況,應由用人單位按本規定規定的審批程序申領許可證書,被聘用的外國人憑許可證書到公安機關改變身份,辦理就業證、居留證後方可就業。外國駐中國使、領館和聯合國系統、其他國際組織駐中國代表機構人員的配偶在中國就業,應按《中華人民共和國外交部關於外國駐中國使領館和聯合國系統組織駐中國代表機構人員的配偶在中國任職的規定》執行,並按本條第二款規定的審批程序辦理有關手續。許可證書和就業證由勞動部統一製作。

第九條 凡符合下列條件之一的外國人可免辦就業許可和就業證:

(一)由我政府直接出資聘請的外籍專業技術和管理人員,或由國家機關和事業單位出資聘請,具有本國或國際權威技術管理部門或行業協會確認的高級技術職稱或特殊技能資格證書的外籍專業技術和管理人員,並持有外國專家局簽發的《外國專家證》的外國人;

(二)持有《外國人在中華人民共和國從事海上石油作業工作準證》從事海上石油作業、不需登陸、有特殊技能的外籍勞務人員;

(三)經文化部批准持《臨時營業演出許可證》進行營業性文藝演出的外國人。

第十條 凡符合下列條件之一的外國人可免辦許可證書,入境後憑職業簽證及有關證明直接辦理就業證:

(一)按照我國與外國政府間、國際組織間協議、協定,執行中外合作交流項目受聘來中國工作的外國人;

(二)外國企業常駐中國代表機構中的首席代表、代表。

第三章 申請與審批

第十一條 用人單位聘用外國人,須填寫《聘用外國人就業申請表》(以下簡稱申請表),向其與勞動行政主管部門同級的行業主管部門(以下簡稱行業主管部門)提出申請,並提供下列有效文件:?

(一)擬聘用的外國人履歷證明;

(二)聘用意向書;

(三)擬聘用外國人原因的報告;

(四)擬聘用的外國人從事該項工作的資格證明;

(五)擬聘用的外國人健康狀況證明;

(六)法律、法規規定的其他文件。

行業主管部門應按照本規定第六條、第七條及有關法律、法規的規定進行審批。

第十二條 經行業主管部門批准後,用人單位應持申請表到本單位所在地區的省、自治區、直轄市勞動行政部門或其授權的地市級勞動行政部門辦理核准手續。省、自治區、直轄市勞動行政部門或授權的地市級勞動行政部門應指定專門機構(以下簡稱發證機關)具體負責簽發許可證書工作。發證機關應根據行業主管部門的意見和勞動力市場的需求狀況進行核准,並在核准後向用人單位簽發許可證書。

第十三條 中央級用人單位、無行業主管部門的用人單位聘用外國人,可直接到勞動行政部門發證機關提出申請和辦理就業許可手續。外商投資企業聘僱外國人,無須行業主管部門審批,可憑合同、章程、批准證書、營業執照和本規定第十一條所規定的文件直接到勞動行政部門發證機關申領許可證書。

第十四條 獲准聘用外國人的用人單位,須由被授權單位向擬聘用的外國人發出通知簽證函及許可證書,不得直接向擬聘用的外國人發出許可證書。

第十五條 獲准來中國就業的外國人,應憑勞動部簽發的許可證書、被授權單位的通知函電及本國有效護照或能代替護照的證件,到中國駐外使、領館、處申請職業簽證。凡符合本規定第九條第一項規定的人員,應憑被授權單位的通知函電申請職業簽證;凡符合第九條第二項規定的人員,應憑中國海洋石油總公司簽發的通知函電申請職業簽證;凡符合第九條第三項規定的人員,應憑有關省、自治區、直轄市人民政府外事辦公室的通知函電和文化部的批件(徑發有關駐外使、領館、處)申請職業簽證。凡符合本規定第十條第一款規定的人員,應憑被授權單位的通知函電和合作交流項目書申請職業簽證;凡符合第十條第二項規定的人員,應憑被授權單位的通知函電和工商行政管理部門的登記證明申請職業簽證。

第十六條 用人單位應在被聘用的外國人入境後十五日內,持許可證書、與被聘用的外國人簽訂的勞動合同及有效護照或能代替護照的證件到原發證機關為外國人辦理就業證,並填寫《外國人就業登記表》。就業證只在發證機關規定的區域內有效。

第十七條 已辦理就業證的外國人,應在入境後三十日內,持就業證到公安機關申請辦理居留證。居留證件的有效期限可根據就業證的有效期確定

第四章 勞動管理

第十八條 用人單位與被聘用的外國人應依法訂立勞動合同。勞動合同的期限最長不得超過五年。勞動合同期限屆滿即行終止,但按本規定第十九條的規定履行審批手續後可以續訂。

第十九條 被聘用的外國人與用人單位簽訂的勞動合同期滿時,其就業證即行失效。如需續訂,該用人單位應在原合同期滿前三十日內,向勞動行政部門提出延長聘用時間的申請,經批准並辦理就業證延期手續。

二、甲方由於生產經營需要經與工會和乙方協商後可以延長乙方工作時間,一般每日不得超過一小時;因特殊原因需要延長工作時間的,每日不得超過三小時,但每月不得超過三十六小時。甲方依法保證乙方的休息休假權利。
2. 第四條 勞動報酬及支付方式與時間

甲乙雙方都必須嚴格執行國家有關安全生產、勞動保護、職業衛生等規定。有職業危害的工種應在合同約定中告知,甲方應為乙方的生產工作提供符合規定的勞動保護設施、勞動防護用品及其他勞動保護條件。乙方應嚴格遵守各項安全操作規程。甲方必須自覺執行國家有關女職工勞動保護和未成年工特殊保護規定。

第七條 勞動合同變更、解除、終止
